Supernus Pharmaceuticals, Inc. (Nasdaq: SUPN) is set for a jury trial starting January 25, 2027 in an antitrust lawsuit over APOKYN (apomorphine HCl), according to its 10-Q filed August 3, 2026. Sage Chemical, Inc. and TruPharma, LLC filed the case on October 3, 2022 in the United States District Court for the District of Delaware, C.A. No. 22-cv-1302 (CJB). They allege that the defendants violated state and federal antitrust law in connection with the drug.

The 10-Q names these defendants: Supernus; Britannia Pharmaceuticals Limited; US WorldMeds Partners, LLC; MDD US Enterprises, LLC and MDD US Operations, LLC, each a Supernus subsidiary; and USWM, LLC. Four individuals, Paul Breckinridge Jones, Sr., Herbert Lee Warren, Jr., Henry Van Den Berg and Kristin L. Gullo, were also named in 2022 and were dismissed from the case in 2024.

The case

The plaintiffs filed an amended complaint on October 16, 2022 that added the MDD subsidiaries, USWM and the four individuals. The 10-Q gives no further description of the antitrust theory and does not state the relief sought. On December 6, 2024, the plaintiffs filed a second amended complaint that added US WorldMeds and USWM back to the case.

Defendants

The 10-Q does not say what roles the four individuals held. The court granted their motion to dismiss on May 31, 2024 and the US WorldMeds and USWM motion on June 4, 2024. Those two returned in the second amended complaint. The filing does not say who else that complaint names.

Where it stands

The defendants filed an omnibus motion to dismiss on January 10, 2023. The court denied it on May 9, 2024 and denied Britannia's separate motion on May 28, 2024. A February 9, 2026 scheduling order set May 8, 2026 as the close of expert discovery. On June 9, 2026, each side submitted dispositive motions and motions to exclude certain expert opinions. The order set September 2, 2026 for briefing to finish. The order sets a pretrial conference for January 15, 2027, and the trial for January 25, 2027.

Supernus says it intends to defend itself vigorously but can offer no assurances that it will succeed. The 10-Q does not estimate a loss for this case.

Related insurance suits

The 10-Q describes two coverage disputes tied to what it calls the "Underlying Action," a lawsuit that alleged competitors of Supernus filed in the District of Delaware against the company, the MDD subsidiaries and others. The filing does not name that case or say whether it is the APOKYN suit. In the first dispute, captioned US WorldMeds Partners, LLC v. Federal Insurance Company, et al., Case Nos. 24-CI-2529, 24-CI-4195, 24-CI-4631 and 24-CI-6988, the company and the MDD subsidiaries, which the filing together calls Enterprises, sought a declaratory judgment against Federal Insurance Company, RSUI Indemnity Company, StarStone Specialty Insurance Company and others to recover insurance benefits. US WorldMeds Partners, RSUI and StarStone filed similar actions, which were consolidated. A court conference was held on May 6, 2026, the next was scheduled for September 9, 2026, and trial is scheduled for October 2027.

In the second, Supernus v. Old Republic Insurance Company, No. 8:24-cv-03733-PJM in the District of Maryland, the court granted the insurer's pre-answer motion to dismiss on March 24, 2026 and dismissed the case with prejudice. Supernus is appealing. A court-ordered mediation on June 24, 2026 produced no settlement. The approved schedule set Supernus's brief for September 11, 2026 and Old Republic's response for October 30, 2026.

Why it matters to shareholders

The coverage cases are unresolved. In the second quarter of 2026, Supernus recognized impairment charges of $54.9 million on its acquired APOKYN intangible asset. It cited the product's performance and a change in its outlook for the brand.

On August 1, 2026, Supernus agreed to a merger with Indivior Pharmaceuticals, Inc. Separately, US WorldMeds Partners won summary judgment on June 5, 2026 in a Delaware Superior Court case over a $30.0 million milestone payment of which Supernus withheld $27.7 million. The 10-Q says the principal balance, interest, fees and costs remain in dispute and are for the court to decide.
