Axsome Therapeutics (Nasdaq: AXSM) told investors in its 10-Q filed August 10, 2026 that no patent suits over Sunosi remain pending after it resolved its cases against the last of the generic drug companies it had sued. One patent suit over Symbravo, against Apotex Inc., is still in discovery. Axsome is the plaintiff in each case.

The Sunosi litigation began on September 13, 2023 as Axsome Malta Ltd. & Axsome Therapeutics, Inc. v. Alkem Laboratories Ltd., et al., No. 2:23-cv-20354, in the U.S. District Court for the District of New Jersey. The six defendants were Hikma Pharmaceuticals USA, Inc.; Unichem Laboratories Ltd.; Sandoz Inc; Hetero USA, Inc., Hetero Labs Limited Unit-V and Hetero Labs Ltd.; Alkem Laboratories Ltd.; and Aurobindo Pharma USA, Inc. and Aurobindo Pharma Limited. The Symbravo suit, Axsome Therapeutics, Inc. v. Apotex, Inc., No. 1:25-cv-16038, was filed in the same court on September 26, 2025.

The case

Both matters are Paragraph IV patent suits. Axsome sued each company over its abbreviated new drug application, or ANDA, for a generic version of Sunosi (solriamfetol) or Symbravo. The 10-Q says that between December 2023 and February 2026 Axsome filed several more related infringement actions against the Sunosi defendants. It does not list the patents or the relief sought. The Sunosi plaintiffs are Axsome Malta Ltd. and Axsome Therapeutics, Inc., and the Symbravo plaintiff is Axsome Therapeutics, Inc.

Axsome's 10-K filed February 23, 2026 adds one detail. On September 25, 2024, Hikma petitioned the Patent Trial and Appeal Board for inter partes review of U.S. Patent No. 11,560,354 (IPR2024-01418). After Axsome and Hikma settled, Hikma and Axsome's Malta subsidiary jointly asked the board to dismiss the petition, and the board granted the request on March 12, 2025.

Defendants

The Sunosi defendants are the companies listed above. The 10-Q treats the Hetero entities together as "Hetero" and the Aurobindo entities together as "Aurobindo." The Symbravo defendant is Apotex Inc. The 10-Q names no individuals.

Where it stands

Axsome settled with Unichem on June 4, 2024, Hikma on March 2, 2025, Hetero on May 21, 2025, Alkem on February 13, 2026 and Aurobindo on June 2, 2026. On August 21, 2024 it agreed to dismiss the actions against Sandoz. Each ANDA filer agreed not to launch a generic solriamfetol product until September 1, 2040 if pediatric exclusivity is granted for Sunosi, or on or after March 1, 2040 if it is not, or earlier under certain circumstances. The 10-K, describing the June 4, 2024 Unichem agreement, gave Unichem's date as June 30, 2042. Axsome's Form 8-K filed June 3, 2026 reported a press release announcing a settlement that resolved all Sunosi patent litigation.

In the Symbravo case, Apotex moved on March 10, 2026 for judgment on the pleadings to dismiss certain of the asserted patents. The motion is fully briefed, and the court has not ruled. The action is in fact discovery. The 10-Q gives no trial date and does not say which patents Apotex's motion targets.

Why it matters to shareholders

Axsome is the plaintiff in each of these cases. Under the settlements as the 10-Q describes them, no ANDA filer may launch a generic solriamfetol product before 2040 unless early-entry terms apply, and the 10-Q does not describe those terms.

The 10-Q says Axsome believes its assertions in pending legal proceedings have merit and does not believe that any of these matters, individually or in the aggregate, will have a material adverse effect on its financial position. As of June 30, 2026 it had determined no potential material losses from claims or legal proceedings that were both probable and reasonably estimable. Axsome also faces stockholder derivative suits, which are covered separately.
