ANI Pharmaceuticals (Nasdaq: ANIP) and its subsidiary Novitium Pharma LLC are in three patent cases in federal court, all opened since April 2026, according to ANI's 10-Q filed August 7, 2026. Orphalan SA sued Novitium, and Xeris Pharmaceuticals, Inc. and Strongbridge Dublin Limited sued Novitium and ANI, over Novitium's generic drug applications.

In the third case Novitium is a plaintiff with Harmony Biosciences Management, Inc. The defendants there are AET Pharma US, Inc., AET Laboratories Private Limited, Alfred E. Tiefenbacher (GmbH & Co. KG) and Sandoz Inc.; Sandoz Private Limited and Sandoz GmbH were dismissed without prejudice on July 7, 2026. Their antitrust counterclaims name Harmony Management and Novitium. Novitium is also a defendant in ranitidine suits in California state court.

The case

Harmony Biosciences Patent Litigation: on April 20, 2026 Harmony Management and Novitium, as exclusive licensor of intellectual property including U.S. Patent No. 11,623,920, sued the AET and Sandoz entities in the District of Delaware (case no. 26-cv-00453-JLH). The complaint alleges that the filing of AET's ANDA No. 218892 infringes the '920 patent.

Orphalan SA v. Novitium: on April 22, 2026 Orphalan sued Novitium in the District of Delaware, alleging that its ANDA No. 218493 infringes U.S. Patent Nos. 10,988,436, 11,072,577, 12,358,861 and 12,358,862.

In re Levoketoconazole Litigation: Xeris and Strongbridge sued Novitium and ANI on June 4, 2026 in the District of New Jersey (No. 2:26-cv-06568) over ANDA No. 221336, citing four patents. They filed a second suit on July 13, 2026 (No. 2:26-cv-08641) citing two of them.

Defendants

Harmony case: AET Pharma US, Inc.; AET Laboratories Private Limited; Alfred E. Tiefenbacher (GmbH & Co. KG); Sandoz Inc.; and, until their dismissal without prejudice on July 7, 2026, Sandoz Private Limited and Sandoz GmbH. Orphalan case: Novitium. Xeris case: Novitium and ANI. Harmony counterclaims: Harmony Management individually, and Harmony Management and Novitium jointly. The 10-Q names no individuals.

Where it stands

In the Harmony case the defendants answered on June 22, 2026 with antitrust counterclaims against Harmony Management individually and against Harmony Management and Novitium jointly, and amended their answer on July 21 to drop the dismissed Sandoz entities. Novitium says it will keep pursuing the case and defend the counterclaims with Harmony.

Novitium answered Orphalan with counterclaims on June 22, and Orphalan answered those on July 10. The court consolidated the two Xeris suits on July 20, 2026 under lead case No. 2:26-cv-02044-JXN-JBC. Novitium disputes liability in the Orphalan case, and ANI and Novitium dispute it in the Xeris case.

Related matters

Novitium and ANI were named in the ranitidine multidistrict litigation in the Southern District of Florida (MDL No. 2924), but the lead plaintiff attorneys voluntarily dismissed ANI from the master complaint. The court dismissed all claims against generic manufacturers with prejudice in July 2021 on preemption grounds. The Eleventh Circuit heard argument on October 10, 2025 and a decision is pending. In California state court Novitium is named in one bellwether case and in later wave cases, and in 29 short form complaints it has not been served with. ANI is not named there. One case naming Novitium, Shlitz, is set for trial on October 19, 2026, and a second, Rodriguez, for after June 2027. Novitium disputes liability.

Why it matters to shareholders

The 10-Q gives no loss estimate for these cases. It says ANI is unable to predict outcomes unless it states otherwise, and that outcomes could include substantial damages, fines and injunctive or administrative remedies that could have a material adverse effect on results or cash flows in a given period. In January 2026 Novitium licensed intellectual property to Harmony Biosciences LLC, and ANI recognized $9.7 million of royalty revenue under that agreement in the three months ended June 30, 2026. The filing does not say whether the '920 patent suit relates to that agreement.
