Amarin Corporation plc (Nasdaq: AMRN) and Hikma settled two lawsuits on Oct 13, 2026, according to its 10-Q filed Oct 28. In the first, Amarin sued Hikma on November 30, 2020 for patent infringement over generic icosapent ethyl capsules. The filing places that case in the District Court for the District of Delaware but gives no case number. Hikma is the defendant.
In the second, Hikma filed antitrust claims against Amarin in the United States District Court for the District of New Jersey, Civil action No. 23-cv-01016, on February 21, 2023. Amarin is the defendant. The 10-Q names the generic maker as Hikma Pharmaceuticals USA Inc.
The details
Amarin alleged that Hikma induced infringement of patents covering the use of Vascepa. The Supreme Court ruled on June 4, 2026 that Amarin failed to state a claim for active inducement, and the parties then agreed to a Confidential Settlement Agreement and Release to dismiss all patent claims with prejudice.
In the antitrust case, Hikma will voluntarily dismiss with prejudice all pending claims, in exchange for a negotiated settlement payment. The filing does not state the amount.
The 10-Q also lists other antitrust complaints against Amarin in New Jersey. Dr. Reddy's (No. 21-cv-10309), Teva (No. 24-cv-04341) and Apotex (No. 24-cv-07041) have filed antitrust complaints against Amarin in New Jersey. In October 2024, Apotex added KD Pharma-Bexbach GmbH, KD Swiss GmbH, Marine Ingredients, LLC, Innova Softgel, LLC, 03 Holding GmbH and Capiton AG as defendants. These are allegations.
