## Key facts

Ultragenyx Pharmaceutical Inc. ([RARE](https://aibio.space/companies/ultragenyx-pharmaceutical/)) said in an [8-K filed October 19, 2026](https://www.sec.gov/Archives/edgar/data/1515673/000119312526424739/rare-20261019.htm) that it and Baylor Research Institute entered into a settlement agreement with Navinta LLC, resolving patent litigation over patents covering DOJOLVI (triheptanoin) oral liquid. The litigation was filed in the U.S. District Court for the District of New Jersey. The 8-K names Ultragenyx, Baylor Research Institute and Navinta LLC as the parties to the settlement. It does not say which of them was plaintiff or defendant, and it gives no case number. The company reports the deal under Item 8.01, Other Events.

## What the settlement does

According to the 8-K, the litigation resulted from Navinta's submission of an Abbreviated New Drug Application to the FDA, seeking approval to market a generic version of DOJOLVI in the United States. Under the settlement, Ultragenyx will grant Navinta a non-exclusive, royalty-free license to market that generic beginning January 1, 2033. That date would be extended to July 1, 2033 if pediatric exclusivity is granted for DOJOLVI, subject to conditions and exceptions the filing calls customary for agreements of this type.

The license is royalty-free, and the 8-K describes no payment between the parties. It does not say whether pediatric exclusivity has been sought, and it gives no reason for the 2033 date beyond that condition. The settlement fixes the earliest date Navinta can sell, but the 8-K does not say what happens to the patents covered by the original suit.

## Other cases and regulators

Ultragenyx says similar patent litigation it brought against other ANDA filers over DOJOLVI remains pending in the same New Jersey court. The 8-K does not name those filers, does not say how many there are, and sets no date for a ruling in any of them. As required by law, the settlement agreement will be submitted to the U.S. Federal Trade Commission and the U.S. Department of Justice. The 8-K also does not say when those filers could seek to launch. It was signed by Howard Horn, executive vice president, chief financial officer and corporate strategy.

## The company's finances

Ultragenyx is a Delaware corporation based in Novato, California, and its common stock trades on the Nasdaq Global Select Market. It reported revenue of $673.0 million for 2025, up from $560.0 million in 2024, but it is far from profitable. Its net loss was $575.0 million in 2025, against $569.0 million a year earlier. Research and development expense rose to $750.0 million from $698.0 million, and cash used in operations was $466.0 million in 2025, up from $414.0 million in 2024.

Cash and cash equivalents were $421.0 million at the end of 2025 and $125.0 million at June 30, 2026. Short-term investments were $259.0 million at year-end 2025 and $167.0 million at June 30, 2026. Cash and cash equivalents were $174.0 million at year-end 2024, when short-term investments were $436.0 million. The filings do not break out DOJOLVI revenue, so the share of the 2025 total touched by the settlement is not disclosed.

## Risks the company itself lists

The risk factors in the 2025 10-K concern the company's development pipeline rather than DOJOLVI. They warn that Ultragenyx's product candidates may cause undesirable side effects, that their safety profile has not been established, and that serious adverse events in gene therapy trials could damage public perception of the whole field. The company cites earlier gene therapy trials using AAV8 vectors, at significantly higher doses than its own, that led to several well-publicized adverse events, including cases of leukemia and death.

The same risk factors say the manufacturing process for its gene therapy candidates is novel, complex and has not been validated for commercial use. Only a small number of contract manufacturers have the experience needed to make them, according to the 10-K. The company also notes that Fast Track, Breakthrough Therapy, RMAT, PRIME or Priority Review designations are at the discretion of regulators, may not speed development, and can be withdrawn.

The settlement lets one generic maker into the DOJOLVI market on a stated date, while other generic filers are still in court. The 8-K does not say how Ultragenyx expects the other cases to end.
